Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement, repair, refund, or compensation depending on the circumstances and whether the goods have a major or minor failure. These Terms and Conditions apply to purchases made through Japan Engine & Marine Pty Ltd, including purchases of outboard motors, marine engines, Japanese automotive engines, transmissions, and related products. Our engines and marine motors are sourced directly from Japan and supplied to customers throughout Australia and, where available, internationally.

1. Acceptance of Terms

By using our website, contacting our sales team, placing an order, or purchasing a product from Japan Engine & Marine Pty Ltd, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2. Products & Descriptions

Products may be new, used, pre-owned, refurbished, or otherwise described on the applicable product listing.
Our engines and marine motors are sourced directly from Japan and may include Japanese-market specifications, components, configurations, or model variations.
We aim to provide accurate product descriptions, photographs, specifications, condition information, and available testing information for each product.
Used engines, transmissions, and outboard motors may show normal signs of previous use, age-related characteristics, and cosmetic imperfections.
Where applicable, available testing information, inspection details, photographs, videos, and condition reports are provided to assist customers in evaluating a product before purchase.
Customers are responsible for reviewing the product specifications and confirming compatibility and suitability for their intended application before purchasing.
Products are supplied subject to the consumer guarantees and rights available under Australian Consumer Law and any applicable warranty expressly provided with the product.

3. Pricing & Payment

Prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.
Applicable taxes and charges will be displayed or communicated as part of the purchasing process.
Full payment is generally required before an order is dispatched unless an alternative payment arrangement has been agreed in writing by Japan Engine & Marine Pty Ltd.
Available payment methods may include bank transfer, card payment, PayPal, or other payment methods offered or approved by our sales team.
An order may not be dispatched until payment has been successfully received and confirmed.

4. Shipping & Delivery

We arrange delivery of engines, outboard motors, and other eligible products to customers throughout Australia.
Shipping costs and availability may vary depending on the product, destination, dimensions, weight, and freight requirements.
International shipping may be available for selected products. Customers should contact us for an international freight quote and applicable shipping information.
Delivery times are estimates only and may vary depending on freight schedules, destination, weather, public holidays, carrier availability, and other circumstances outside our reasonable control.
Customers are responsible for providing an accurate delivery address and ensuring that the location is suitable for receiving heavy freight.
Suitable unloading equipment may be required for larger engines, outboard motors, pallets, crates, or other heavy freight.

5. Returns, Refunds & Warranty

Returns, refunds, replacements, repairs, and warranty matters are handled in accordance with our applicable policies and the rights and guarantees available to customers under Australian Consumer Law.

6. Customer Responsibilities

Customers should carefully review the product specifications, photographs, condition information, and listing details before placing an order.
Customers are responsible for confirming that the engine, transmission, or outboard motor is compatible with their vehicle, boat, or intended application.
Customers should have engines and marine motors professionally inspected and installed by a suitably qualified mechanic or marine technician.
Customers should follow the applicable manufacturer's installation, operation, servicing, maintenance, and safety requirements.
Customers are responsible for ensuring that any required modifications, installation components, controls, wiring, mounts, gauges, or accessories are suitable for their application.

7. Installation & Modification

Japan Engine & Marine Pty Ltd recommends that all engines, transmissions, outboard motors, and marine equipment be installed by an appropriately qualified professional.

We are not responsible for damage caused by incorrect installation, improper setup, incompatible components, incorrect wiring, incorrect tuning, overheating, lack of lubrication, misuse, neglect, or modifications carried out after delivery, except where liability cannot lawfully be excluded under Australian Consumer Law.

8. Used & Japanese-Sourced Products

Many of our products are sourced directly from Japan and may have previously been used in Japanese vehicles, boats, or other applications. As a result, individual products may have different operating histories, cosmetic conditions, specifications, or accessories.

Customers should carefully review the individual product listing and available information before purchase. Where additional information is required, customers are encouraged to contact our team before placing an order.

9. Limitation of Liability

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under Australian Consumer Law.

To the maximum extent permitted by law, Japan Engine & Marine Pty Ltd is not responsible for loss or damage arising from circumstances outside our reasonable control. This includes delays caused by freight carriers, natural events, severe weather, government actions, transport disruptions, or other circumstances beyond our reasonable control.

Nothing in these Terms limits or excludes liability where doing so would be unlawful.

11. Governing Law
